SERVICE PROS OF AMERICA Corp (Service Agreement)
Terms and Conditions Effective 12/12/18

If you access and use this Web site (the “Service Pros of America .com”), you accept and agree to be bound by and comply with these terms (the “Terms”). If
you do not accept the Terms, do not use the Site.

TERMS. You authorize Service Pros of America Co. to charge the indicated invoice amount; Customer execute this Agreement/Contract by making payments towards this Invoice/contract and by ordering any type of services, work, or any other products from Service Pros of America .com and or Service Pros of America Corp. The Customer has the authority to order this work and agree to pay for all services and parts rendered by Service Pros of America Corp. The Customer agree and gives the right and authority to Service Pros of America Corp and it’s employees to enter into the property to perform all work ordered.

DIAGNOSTIC SERVICE. Customer agree to pay for Diagnostic services rendered for diagnosing customers equipment, Residential Service Diagnostic fee in the amount of 1hour for paid labor will be credited toward any repair approved by the customer only if customer agrees to have such equipment repaired by Service Pros of America Corp. within 30 days of the work proposal. Commercial equipment diagnose fee may be credited back to customer at Service Pros of America sole discretion and approval only if customer approves a repair or other work within 30 days of approval, and only 1 hour of paid diagnostic fee will be credited toward a repair or work performed.
AC or refrigeration Diagnostic does not cover leak checking or testing with nitrogen or Freon. If a major leak testing is required customers will have to pay the difference for such service.

REFUND & CANCELLATION  POLICY

Cancellation after ordering service online – from www.serviceprosofamerica.com. Customer has up to 30 minutes to cancel any service ordered through our website for a full refund. However if a customer cancels after 30 minutes a refund may not be allowed. any service canceled after the 30 minutes of the allowed time, a service fee will be charged in the amount of 50% of the total funds collected and the remaining amount will be give as an instore credit.  customer has up to 60 days to use any credit given my Service Pros of America Corp. if customer does not use their credit within the allowed time all credit will be voided.

Cancellation of set appointments – 24 hours notice is required for cancellation of any single service set appointment expect ac diagnostic appointments’ . Missed service appointments which is cause due to the customer fault or by  not making the property accessible  for us to enter the property without the appropriate notice will be
charged as if attended.

DIAGNOSTIC SERVICE CALL CANCELLATION. To cancel this ANY AC Diagnostic Service for a full refund please contact Service Pros of America within 30 minutes of placing order or before a technician is dispatched. You may not be entitled to a refund after a technician is dispatched to performed serviced ordered.

Medical Cancellations – Cancellation is permitted where an customer  is not able to participate in a single sessions for medical
reasons. A doctor’s note confirming that the customer was not permitted to participate is required.

SCHEDULING FOR SERVICE. The Customer agreed to call/contact Service Pros of America Corp at (954 658 9511). to set up all diagnostic services or any other services ordered. Customers agree to follow all service schedule time and date set by Service Pros of America Corp in order for work to be performed. Customers MUST be present at the time of service or must leave someone at the property who is 18 years of age or older, and Must provide a safe environment for company employees to perform all work. If a customer does not provide a safe environment for Service Pros of America employees to perform work, customers agree to give Service Pros of America the sole right to walk away from the job and to retain all money/parts paid without any refund to the customer. Customers agreed to give full property access to Service Pros of America employees in order to perform work on equipment.  Any Missed service appointments which is cause due to the customer fault or by  not making the property accessible  for us to enter the property without the appropriate notice will be
charged as if attended.

RESCHEDULING FOR SERVICE. Customers agree to call Service Pros of America Corp to reschedule all scheduled work, 24 hours before a technician is dispatched to the location of service, except for diagnostic services. If the customer calls to reschedule a service ordered after the technician is dispatched to the customers location, the customer agrees to pay the service fee to dispatch the technician for each day of missed service. Only in a documented case of and emergency health condition, accident or act of God emergencies the customer will not be charged for any missed service appointments. There will be a service charge fee for all missed service appointments that is not due to no fault of Service Pros of America Corp. The customer agree and gives sole right to Service Pros of America to reschedule any work cause by unforeseen circumstances including but not limited to the right to reschedule work due to bad weather conditions, act of God, company hardship, lack of parts availability, heavy traffic conditions, employee emergency, , accidents and road shutdowns.

PAYMENT DUE AT TIME OF SERVICE. The Customer agrees that Service Pros of America will retain title to any equipment or materials furnished until final payment is made. This debt is due and payable upon time of service. In case this debt is not paid in full within 30 days, the debt shall bear the highest legal rate of interest. In case suit shall be brought for the collection or enforcement thereof or same as to be collected or enforced upon demand of an attorney, the customer agrees to pay reasonable collection cost required to enforce and collect this debt.

Customers/Card holders acknowledge receipt of goods and/or services in the amount of the TOTAL shown. If paid by charge card the holder agrees to the obligations set forth in their card agreement.

GENERAL HOLD HARMLESS CLAUSE. The Customer agrees to HOLD-HARMLESS defend and indemnify Service Pros of America Corp. it’s agents, officers ,directors, shareholders and employees from liability and property damage caused by work performed. Customers also agree to HOLD-HARLESS Service Pros of America Corp and its employees from any part or parts that may become damaged due to servicing of the equipment.

HOLD-HARMLESS CLAUSE – COIL CLEANING I the customer holds harmless Service Pros of America Corp and its employees, officers from any liability and Coil damages that may be caused from removing/reinstalling and cleaning the Evaporator or Condenser Coil. The customer fully understands that due to the nature of cleaning the coils, the equipment coils may be become damaged and unusable. The customer agrees to pay for labor and parts needed to replace the damaged coil, and if the ac coil has become obsolete the customer agree to replace the entire equipment at their discretion.

HOLD HARMLESS CLAUSE DUCT CLEANING. The Customer agrees to HOLD-HARMLESS defend and indemnify Service Pros of America Corp. it’s agents, officers ,directors, shareholders and employees from liability and duct work damages that may be caused or arise from the Air Duct Cleaning Process.

WARRANTIES Service Pros of America Corp will warranty all parts installed for a period of 30 days unless otherwise agreed. There will be NO warranty on temporary repairs including but not limited to any type of cleaning service, drain cleaning, maintenance services, air filter replacement, evaporator/condenser cleaning, drain cleaning, Freon leak repairs, duct cleaning, dryer vent cleaning, or and any type of diagnostic services.

PARTS DISPOSAL I request any defective parts be removed and disposed of as a service to me. I understand that any parts removed will be discarded or recycled and cannot be returned to the customer.

ACCEPTANCE OF WORK PERFORMED I accept the work was done as described, and if I disagree with the quality of the work I the customer agree to give Service Pros of America Corp a written notice about my concerns no later than 24 hours after completion of work, and i agree to give Service Pros of America Corp. unlimited tries to fix any concerns without requesting a refund for any paid service.
